Privacy policy · v2.0 · effective 25 August 2021

The short
version.

Your privacy is very important to us. We don't share your personal information with anyone without your consent except to comply with the law, develop our products and services, or protect our rights. We aggregate and de-identify information where we can, and we give you several ways to control your data.

Our principles

01
Your privacy is critically important to us and we handle your information accordingly.
02
We don't share your personal information with anyone without your consent except to comply with the law, develop our products and services, or protect our rights.
03
Information you upload or post may be visible to others depending on your privacy settings.
04
We aggregate and de-identify information about our members to use for business purposes.
05
We give you several ways to control the privacy of your personal information and are continuously working to enhance the privacy options available to you.
01

Information we collect

Flash Digital collects information about you, including personally identifiable information, if you choose to share it — for example by registering an account, completing or uploading activities, posting comments, endorsing or questioning content, or connecting with contacts. We also collect information about how you use our apps and Services.

We automatically collect a variety of technical information, including location, device and network information, cookies, log files and analytics signals.

02

Cookies and similar technologies

When you visit our Services a cookie may be stored on your device. Cookies assign a unique identifier to your browser that has no meaning outside our Services and do not contain personally identifying information; we use them to personalise your experience and to deliver content relevant to your interests. After you sign in, we may save session information so you don't have to re-enter it during that session.

The only way to opt out of cookie-based tracking is to manage the settings on your browser or mobile device — refer to your device's documentation for instructions. Disabling cookies may make certain features of our Services unavailable.

We may also use your IP address to identify you, administer the Services, and assist in diagnosing problems with our servers.

03

Log files

Our Services use log files. Stored information includes IP addresses, browser type, internet service provider, referring and exit pages, platform type, date/time stamps, and number of clicks. This information is used to analyse trends and administer the Services.

04

Analytics services

We use third-party analytics providers to understand how our apps are used and to help improve them. Where applicable, Apple discloses this on the App Store as Usage Data → Product Interaction (collected but not linked to your identity).

05

Children's privacy

Our Services are not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we may have accidentally received such information, please contact us immediately.

06

Third parties

We may collect personally identifiable information about your activities over time and across third-party websites or online services when you use our Services. We may obtain additional information about you from third parties such as marketers, partners and researchers, and combine that with information we collect.

We do not currently recognise or respond to browser-initiated Do Not Track signals, as the industry has not finalised a Do Not Track standard. For more information about Do Not Track, see allaboutdnt.com.

07

How we use information

We primarily use the information we collect to administer and operate our Services. We also use your information to analyse, develop and improve the Services, to market the Services where permitted, to provide support, to protect members and enforce our Terms of Service, to promote safety, and to communicate with you.

08

How information is shared

Subject to your privacy settings, your profile, username, photos, activities, kudos and comments may be visible to others. If you link your account to social networks, your activities may be visible outside our Services.

When you use third-party apps, plug-ins or websites that integrate with our Services, those third parties may receive your information and content, including private activities. Information collected by them is subject to their terms and policies.

We may share your information with service providers who support and improve the Services on our behalf — they have access only to the information necessary to perform their limited functions and are required to protect it. We may also share information within Flash Digital to operate, improve or promote the Services, and with affiliates under common control, who are required to comply with this Policy.

If we ever become involved in a business combination, bankruptcy, reorganisation or similar transaction, your information may be transferred as part of that transaction.

09

Aggregated and de-identified information

We may modify, de-identify and aggregate the information you make available so that it does not personally identify you, and use, sell, licence or share that aggregated data for research, business and other purposes. If you make information publicly available on our Services, it is capable of being publicly viewed even when aggregated.

10

Legal requirements & DMCA

We may share your information with third parties, including law enforcement and governmental agencies, if we determine that disclosure is reasonably necessary to comply with the law, respond to court orders, prevent serious bodily injury, address national-security concerns, prevent fraud or abuse, or protect our operations and legal rights.

If we receive a Digital Millennium Copyright Act (DMCA) notice, we will forward it as submitted, without deletions.

11

How we protect information

We take several measures to safeguard the collection, transmission and storage of data. These depend on the sensitivity of what we hold. We do not guarantee the security of information you share with us and are not responsible for theft, loss or inadvertent disclosure — no system is 100% secure.

Our servers use firewall technology and SSL where supported. You should use a security-enabled browser when submitting personal information, watch for https:// URLs, and check the validity of any site you connect to securely.

12

Opt-out and email preferences

To stop receiving marketing emails, use the unsubscribe link in any email or contact us directly. Service emails (purchase confirmations, Terms updates, etc.) generally cannot be opted out of as they are necessary to provide the Service.

13

Updating your account information

You can correct, amend or delete account information at any time in your account settings. If you need help, contact us — we generally respond within 7–10 business days.

14

Australian operation

Our Services are operated from Australia. If you are outside Australia and choose to use them or provide information to us, your information will be transferred, processed and stored in Australia. Australian privacy laws may differ from your jurisdiction, and you acknowledge and consent to that.

15

Retention of information

We retain information for as long as it is necessary and relevant for our operations. Information no longer necessary is de-identified or securely disposed of. We may retain information from closed accounts to comply with the law, prevent fraud, resolve disputes, troubleshoot, enforce Terms, and take other actions permitted by law.

16

Changes to this Policy

If we make changes to this Privacy Policy, the updated version will be posted on the Services in a timely manner. Significant changes will be communicated with a prominent notice. Continued use of the Services after a change constitutes agreement to it. If you object, you may cease using the Services and deactivate your account.

17

Disclaimer

No data transmission over the Internet can be guaranteed to be absolutely secure. While we work hard to protect your personal information, transmitting it is done at your own risk.
